This Privacy Policy describes how Springdel collects, uses, and handles users personal data as well as your related choices regarding use, access, and correction when using our websites, software, and services (hereafter collectively “Services”). By using the Services, you agree to the collection and use of information in accordance with this Privacy Policy.
DATA AND INFORMATION COLLECTION
Springdel collects and uses the following information to deliver, improve, secure, and promote our Services.
Account information. Springdel collects user account information when users register or make adjustments to their account. Account information includes, but is not limited to, email addresses, user names, and passwords. For Springmatic Edge Enterprise, billing information will also be collected for the purposes of payment processing.
User data and information. Springedel Services are designed as a fast and easy way to manage many fleets of devices. To make that possible, Springdel stores, processes, and transmits any and all information related to the managed devices.
Usage information. Springdel may collect information related to how the Services are used to better understand and improve the Services.
Device information. As part of the Springmatic Edge management platform, device data will be collected to aid users in managing their equipment. This data includes, but is not limited to, device serial numbers, IMEI, model number, vendor, list of running applications, files, and device statics - i.e. battery level, storage capacity, location, etc. Springdel does not independently read or copy files and/or application information from the devices; Springdel enables only the ability for users to remotely access it. All devices managed on the platform must be enrolled in an opt-in manner by approved users. Once devices are removed from the platform, Springmatic Edge can no longer and will no longer have access to the device and its data.
Bases for processing user data. Springdel collects and uses the data described above in order to provide users with the Services in a reliable and secure manner. Springdel also collects and uses this data for our legitimate business needs. To the extent Springdel process user data for other purposes, Springdel asks for user consent in advance.
DATA SHARING
Springdel does not and will not sell user information to advertisers or other organizations engaging in marketing promotion. However, in striving to build a worldwide management service, certain third-parties may require access to data in the platform.
Others working for and with Springdel. Springdel uses certain trusted third parties, including, but not limited to, IT hosting and service providers, for the business purposes of helping provide, improve, protect, and promote our Services. Springdel will be responsible for the access and handling of user information required by third parties in fulfilling the above described duties.
Bases for processing user data. Springdel collects and uses the data described above in order to provide users with the Services in a reliable and secure manner. Springdel also collects and uses this data for our legitimate business needs.
Legal and Ethical Considerations. Springdel may disclose user information to third parties if Springdel determines that such disclosure is reasonably necessary to: (a) comply with any applicable law, regulation, legal process, or appropriate government request; (b) protect any person from death or serious bodily injury; (c) prevent fraud or abuse of Springdel or our users; (d) protect Springdel’s rights, property, safety, or interest.Stewardship of user data is critical to us and a responsibility that Springdel takes seriously. Springdel is obligated to abide by the following Government Request Principles when receiving, scrutinizing, and responding to government requests (including national security requests) for user data.
DATA PROTECTION
Security. Springdel is dedicated to keeping user information secure and follows industry best practices including encrypting web traffic and API keys for securing sensitive information. All information shared to the Springmatic platform uses standard TLS/SSL encryption, but as with any Internet-based service users should be mindful of what information is being shared.
User Control. Users can access, amend, download, and delete user personal information by logging into user Springdel account and going to user account settings page.
Retention. The Company will retain user information only for as long as is necessary for the purposes set out in scope of the Service agreement. When users sign up for an account with us, Springdel will retain information users store on our Services for as long as the user account exists or as long as Springdel needs it to provide the Services. If users delete their account, Springdel will initiate deletion of this information within 30 days.
NOTE: (1) There might be some latency in deleting this information from our servers and back-up storage; and (2) Springdel may retain this information if necessary to comply with our legal obligations, resolve disputes, or enforce our agreements.
DATA RESIDENCY AND TRANSMISSION
Around the world. Springdel may store, process, and transmit data in the United States and locations around the world—including those outside the user’s country or other governmental jurisdiction where the data protection laws may differ from those from your jurisdiction.Data may also be stored locally on the devices users use to access the Services.
Data Transfers. When transferring data from the European Union, the European Economic Area, the United Kingdom, and Switzerland, Springdel relies upon a variety of legal mechanisms, such as contracts with our customers and affiliates, Standard Contractual Clauses, and the European Commission’s adequacy decisions about certain countries, as applicable.EU-U.S. Privacy Shield and Swiss-U.S. Privacy Shield. Springdel complies with the EU-U.S. and Swiss–U.S. Privacy Shield Frameworks as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal data transferred from the European Union, the European Economic Area, the United Kingdom, and Switzerland to the United States, although Springdel does not rely on the EU-U.S. Privacy Shield or Swiss-U.S. Privacy Shield Frameworks as a legal basis for transfers of data.Springdel is subject to oversight by the U.S. Federal Trade Commission. JAMS is the US-based independent organization responsible for reviewing and resolving complaints about our Privacy Shield compliance—free of charge to users. Springdel asks that users first submit any such complaints directly to us via [email protected]. If users aren’t satisfied with our response, please contact JAMS at https://www.jamsadr.com/eu-us-privacy-shield. In the event user concern still isn’t addressed by JAMS, users may be entitled to a binding arbitration under Privacy Shield and its principles.
DATA ACCESS AND CONTROL
Users have control over the data collected, used, and shared.For example, users can:Delete device profiles, devices and related data.Change or correct personal data.Access and download copies of the data elsewhere.
CHANGES IN DATA STEWARDSHIP
If Springdel is involved in a reorganization, merger, acquisition, or sale of assets, user data may be transferred as part of that deal. Springdel will notify users of any such deal and outline user choices in that event.Springdel may revise this Privacy Policy from time to time, and will post the most current version on our website. If a revision meaningfully reduces user rights, Springdel will notify users.
USAGE BY MINORS
The Springmatic Edge management platform is not designed for use by minors under 18 years of age and Springdel does not and will not knowingly collect information from minors.
LAWS OF THE LAND
This Agreement shall be governed by the laws of Ontario, Canada. By using the Service, users waive any claims that may arise under the laws of other states, countries, territories or jurisdictions.
CHANGES TO THE POLICY
Springdel may update our Privacy Policy from time to time. You are advised to review this Privacy Policy periodically for any changes. Changes to this Privacy Policy are effective when they are posted on the page.
